In addition, when using these particular services, you shall be subject to any posted guidelines or rules applicable to such services. Any participation in this Service will constitute acceptance of this agreement. If you do not agree to abide by the above, please do not use this Service.

2. Description of Service

SoftSkillHero provides users with resources and tools to practice and improve their soft skills. The Service is provided "as is" and "as available" without any warranties of any kind.

3. User Responsibilities

As a user of the Service, you agree to use the features provided in a manner consistent with all applicable laws and regulations. You agree not to engage in any of the following prohibited activities:

• Accessing the Service's APIs programmatically or through automated means without express permission.
• Using the Service for any unlawful purpose or for the promotion of illegal activities.
• Attempting to interfere with or disrupt the Service or its servers or networks.
• Copying, distributing, or disclosing any part of the Service in any medium, including without limitation by any automated or non-automated "scraping".
• Using the Service in a way that could harm or be harmful to minors.
• Submitting content on this website that contains hate speech, harassment, threats, sexually explicit material, or other content that violates our community standards.
• Attempting to jailbreak or bypass safeguards in our AI-powered features by submitting jailbreaking content or prompts designed to manipulate the system.

We reserve the right to terminate accounts for suspicion of unfair use or any violation of these terms.

4. Account Creation

To access certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Intellectual Property

All content in the Service, including text, graphics, logos, images, and software, is the property of SoftSkillHero or its content suppliers and is protected by international copyright laws. You agree not to copy, distribute, modify, or create derivative works from any content without express written permission from SoftSkillHero.

6. User Content

When you submit content to our Service, you understand that:

• Your inputs will be processed by third-party AI services to generate responses.
• We do not store the specific content of your interactions with AI-powered features, but do track completion status and timing information.
• You should not submit confidential, proprietary, or sensitive personal information through any AI-powered features.

Payments & Refunds

Some features of the Service may require payment. Payment processing is handled by Paddle, which acts as the merchant of record for all transactions. Please refer to Paddle's Terms and Conditions and Paddle's privacy policy.

7. Service Availability

We do not guarantee that the Service will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Service, resulting in interruptions, delays, or errors. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Service during any downtime or discontinuance of the Service.

8. Third-Party Services

The Service integrates with third-party services, including AI providers and payment processors. We are not responsible for the content, privacy policies, or practices of any third-party services. You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of any such content, goods, or services available on or through any such third-party services.

9. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
